New Construction: Avoid One Big Headache: Get A Warranty

Tkohomes_r3_c3Does Idaho Statute require a one-year warranty on all new construction in Idaho? This is one question that I have been asked several times and have gotten different answers for. So I thought I would get the official answer.

According to the Idaho Real Estate Commission’s July 2007 issue of the Real Estatement “ There are no one-year warranty required by statute.” It does go on to clarify that there are certain warranties that go along with a builder’s membership in different associations and there are warranties available through third parties.

For a warranty to be an included as an enforceable part of the purchase and sale agreement, the agreement must either expressly state the terms of the warranty or specifically reference a separate document that outlines what the terms of the warranty are. Unless a warranty is sufficiently identified in the agreement, it will not be an enforceable term of the sale.

So before you buy a new house, be sure you see,read and understand the builder’s home warranty. And then be sure it is included in the purchase and sale agreement.

I have found the larger builders such as Corey Barton, and Hubble homes have the one year warranties down to a science. Their success depends on the recommendations of their clients. The best warranty is to talk to home owners that have used a particular builder and get some feeling for how well they were taken care of. In my mind that is more important that anything on paper.
